Notice 017 – Turkey – ATR and Rule of Origin

Notification regarding Certificates of Origin for Turkey

We have been made aware that the Turkish customs authority have issued a notice, effective from the 28th February 2018, that for certain goods where in their opinion, there is insufficient evidence of EU origin to support an ATR preference document, an EC Certificate of Origin may be needed to be sent with the ATR to support origin claim.

We are currently aiming to clarify the situation with the relevant authorities and will update you when we have further information.

Brief overview of rule of origin for Preferential Certificates to Turkey

For goods being imported/exported between the EU and Turkey will normally qualify for preference if they:

(a) originate in, or

(b) are in free circulation in either the Union or Turkey.

The following are considered to be in free circulation:

(a) Imports from outside the EU or Turkey on which:

 all import formalities have been completed

 any customs duties or equivalent charges have been paid and not repaid in whole or in part

(b) Goods manufactured in the EU and/or Turkey wholly or partly from materials or parts originating outside the EU or Turkey, provided that:

 all import formalities for the materials or parts have been completed

 any customs duties or equivalent charges have been paid and not repaid in whole or in part

If items did not originate in the EU or Turkey, and are imported under ATR movement certificates, additional customs taxes will be imposed based on the column “Other Countries”. The additional customs tax rates generally vary between 6% and 25%. Check with your customer before sending non-EU origin goods with an ATR Form to Turkey.
